Artikel 1. Definitionen

Serverion: Serverion mit Sitz in Brielle und eingetragen bei der Handelskammer unter Aktenzeichen 70564728 .

Artikel 2. Angebot, Angebot und Annahme

Artikel 3. Leistung des Dienstes

1. Nach Abschluss des Vertrags wird Serverion den Service so bald wie möglich gemäß dem Angebot, der elektronischen Bestellung oder der Bestellung per Brief oder Fax ausführen.

Artikel 4. Preise

1. Sofern nicht anders angegeben, verstehen sich alle Preise zuzüglich Umsatzsteuer und sonstiger staatlicher Abgaben.

Artikel 5. Hosting und verwandte Dienste

1. Im Übrigen gelten die Bestimmungen dieses Artikels auch, wenn der Dienst (auch) Dienstleistungen im Zusammenhang mit der Speicherung und / oder Weitergabe des vom Kunden gelieferten Materials an Dritte, wie im Falle von Webhosting- oder E-Mail-Diensten, erbringt.

Artikel 6. Domainnamen und IP-Adressen

Artikel 7. Verfügbarkeit des Dienstes

5. Artikel 9. Störungen und höhere Gewalt

Artikel 10. Dauer und Kündigung

5. 6. Artikel 11. Zahlungsbedingungen

Artikel 12. Rechte an geistigem Eigentum

1. Alle geistigen Eigentumsrechte an sämtlichen Materialien, Software, Analysen, Entwürfen, Dokumentationen, Ratschlägen, Berichten, Angeboten sowie vorbereitenden Materialien, die im Rahmen des Dienstes entwickelt oder zur Verfügung gestellt werden, liegen ausschließlich bei Serverion oder seinen Lizenzgebern.
2. Der Kunde erwirbt nur die Benutzerrechte und -befugnisse, die sich aus dem Geltungsbereich des Vertrags ergeben oder die schriftlich gewährt werden. Im Übrigen wird der Kunde die Software oder andere Materialien nicht vervielfältigen oder veröffentlichen.
3. Dem Kunden ist es nicht gestattet, Bezeichnungen in Bezug auf Urheberrechte, Marken, Handelsnamen oder andere geistige Eigentumsrechte aus den Materialien zu entfernen oder zu ändern, einschließlich Bezeichnungen in Bezug auf die Vertraulichkeit und Geheimhaltung der Materialien.
4. It is Serverion allowed to take technical measures to protect the materials. If Serverion has protected the materials by means of technical protection, the Client is not permitted to remove or avoid this protection.
5. Any use, reproduction or disclosure of the materials that fall outside the scope of the Agreement or granted user rights is considered a copyright infringement. The Client shall pay Serverion an immediately due and non-judicial moderation penalty of EUR 2,000 per infringing act , without prejudice to Serverion 's right to be compensated for its damage caused by the infringement or to be allowed to take other legal measures to end the infringement.

Artikel 13. Vertraulichkeit

1. Parties will treat information that they provide to each other before, during or after the execution of the Agreement confidentially when this information is marked as confidential or when the receiving party knows or should reasonably suspect that the information was intended to be confidential. Die Parteien legen diese Verpflichtung auch ihren Mitarbeitern und von ihnen zur Durchführung des Vertrags beauftragten Dritten auf.
2. Serverion wird nicht zur Kenntnis nehmen Daten, die der Client speichert und / oder über die Systeme der Serverion verbreitet, es sei denn , dies für die ordnungsgemäße Durchführung des Vertrages erforderlich ist oder Serverion verpflichtet ist , dies zu tun auf Grund einer Rechtsvorschrift oder Gerichtsbeschluss. In diesem Fall wird Serverion sich bemühen, die Kenntnis der Daten so weit wie möglich zu beschränken, soweit dies in seinem Verantwortungsbereich liegt.

Artikel 14. Änderungen der Allgemeinen Geschäftsbedingungen

1. Serverion behält sich das Recht vor, diese Allgemeinen Geschäftsbedingungen zu ändern oder zu ergänzen.
2. Änderungen gelten auch für Vereinbarungen, die bereits unter Einhaltung einer Frist von 30 Tagen nach Veröffentlichung der Änderung auf der Serverion- Website oder per E- Mail geschlossen wurden . Änderungen von untergeordneter Bedeutung können jederzeit vorgenommen werden.
3. Wenn der Kunde eine Änderung dieser Allgemeinen Geschäftsbedingungen nicht akzeptieren möchte, kann er den Vertrag bis zu diesem Datum kündigen, bis die neuen Allgemeinen Geschäftsbedingungen in Kraft treten.

Artikel 15. Schlussbestimmungen

1. Für diese Vereinbarung gilt niederländisches Recht.
2. Soweit die zwingenden gesetzlichen Vorschriften nichts anderes vorschreiben, werden alle Streitigkeiten, die sich aus dieser Vereinbarung ergeben können, dem zuständigen niederländischen Gericht in Amsterdam vorgelegt.
3. Sollte eine Bestimmung aus diesem Vertrag unwirksam sein, berührt dies nicht die Gültigkeit des gesamten Vertrags. Die Vertragsparteien ersetzen in diesem Fall (eine) neue Bestimmung (en), durch die der Zweck des ursprünglichen Vertrags und der Allgemeinen Geschäftsbedingungen so weit wie rechtlich möglich festgelegt wird.
4. Unter diesen Bedingungen umfasst „schriftlich“ auch E-Mail und Kommunikation per Fax, vorausgesetzt, die Identität und Integrität der E-Mail oder des Faxes ist hinreichend nachgewiesen.
5. Die Version der von Serverion empfangenen oder gespeicherten Mitteilungen , die gemessen (überwacht) werden, wird als authentisch angesehen, sofern der Kunde das Gegenteil nachweist.
6. Die Parteien werden sich stets unverzüglich über jede Änderung von Name, Postanschrift, E-Mail-Adresse, Telefonnummer und auf Wunsch der Bank- oder Girokontonummer informieren. Der Client muss diese Änderungen über My Serverion implementieren . Wenn der Kunde nachweislich in Verzug bleibt und unter den zuletzt angegebenen Kontaktdaten nicht mehr erreichbar ist, hat Serverion das Recht, kostenpflichtige Dienste zum Ende der Vertragslaufzeit zu kündigen und nicht bezahlte Dienste sofort zu stornieren.
7. Jede Partei ist nur mit vorheriger schriftlicher Zustimmung der anderen Partei berechtigt, ihre Rechte und Pflichten aus dem Vertrag auf einen Dritten zu übertragen.
8. Die Allgemeinen Geschäftsbedingungen wurden in niederländischer und englischer Sprache verfasst. Bei inhaltlichen oder sachlichen Abweichungen ist der niederländische Text verbindlich.

Refund policy

We can refund purchases made with credit cards or PayPal to the source account. Please note that Serverion has no control over any additional charges that PayPal or credit card companies may charge, so you’ll need to contact them directly.

Deposits made using cryptocurrencies are non-refundable.

 

Domain Names

As stated in our Domain Registration Agreement, domain registrations and renewals are final. However in some cases, we may provide a refund if you have a valid reason for requesting a new domain name cancellation — you will need to Contact Us within 5 days (120 hours) after registration.

Please note that cancellation and refund may be not possible due to restrictions imposed by the applicable registry or registry operating company.

Refunds are not possible for Premium Domains. It is not possible to change or edit domain names after registration, so please ensure correct spelling before confirming your domain purchase.

Hosting Services

Serverion offers a Refund Policy on new purchases of Shared, Reseller, VPS Hosting, and Dedicated servers.

Please note that renewals of hosting services may be refundable in case you cancel your hosting package within 48 hours after renewal. In other cases a prorated refund may be provided upon consideration.

It is required to cancel the hosting account and contact us by submitting a ticket to the Billing/Sales department and providing the cancellation ID.

Shared, Reseller & VPS Packages

Open to a full refund within 30 days of purchase, giving you plenty of time to test their overall performance.

Please mind that only first-time hosting accounts are eligible for our 30 Day Money Back Guarantee. For example, if you’ve previously purchased a Shared Hosting package and cancelled it with a refund, you will not be eligible for any further shared hosting refund.

Additional third-party software licenses (like cPanel or Softaculous) are non-refundable.

 

Dedicated Servers

First-time Dedicated purchases are refundable (excluding license prices) within 1 week of the delivery date.
